Terms of Service

Last updated: 17 July 2026. This is a pre-launch draft and will be finalised with Namibian legal counsel before commercial launch.

1. Who we are

Africa Bitcoin Wealth Fund ("ABTC", "we", "us") provides a Bitcoin-native savings and wealth transfer platform. Our services include converting your Namibia Dollar (NAD) or South African Rand (ZAR) contributions into Bitcoin, safekeeping that Bitcoin in a policy vault, and transferring it to your nominated beneficiaries in accordance with your policy.

2. Regulatory status

Our services constitute virtual asset services under the Namibian Virtual Assets Act, 2023 (Act No. 10 of 2023). ABTC is preparing its licence application to the designated Regulatory Authority and is not yet licensed. We will not onboard paying clients or take custody of client assets until the required licences are issued. Nothing on this platform is investment, legal or tax advice.

3. Custody of your Bitcoin

In line with section 16 of the Virtual Assets Act, 2023:

  • Bitcoin held in your policy vault is held by us on your behalf and remains your property at all times. It does not form part of our assets.
  • Your Bitcoin is not subject to the claims of our creditors, including in the event of our insolvency.
  • Each policy is assigned its own segregated vault address, and we maintain a sufficient amount of Bitcoin in safekeeping to meet our obligations to every client at all times.
  • Accounts relating to client virtual assets are kept separate from our own operating accounts (section 20).

4. Eligibility, KYC and AML

You must be 18 or older (or a parent/guardian operating a Kids account) and complete identity verification before your policy is activated. We collect and verify identity documents, address, and source-of-funds information as required by the Financial Intelligence Act, 2012 and related anti-money-laundering laws. We may decline, suspend or terminate service where verification cannot be completed, and we report as required by law. Outbound transfers of Bitcoin are accompanied by required originator and beneficiary information as prescribed under section 18 of the Virtual Assets Act.

5. Contributions and billing

Plans are billed monthly in NAD or ZAR (exchanged at the 1:1 peg). Contributions are converted to Bitcoin at the prevailing market price at the time of processing and credited to your policy vault. Conversion rates and any fees are disclosed before you subscribe.

6. Succession and beneficiaries

You may nominate beneficiaries and configure the succession trigger for your policy vault. On a valid trigger event and successful verification of your beneficiaries, the Bitcoin in your vault is transferred according to your allocation instructions. Beneficiary claims are subject to identity verification and applicable law.

7. Risk disclosure

Bitcoin is a volatile asset. The value of your policy can go down as well as up, and past performance is not an indication of future results. We do not guarantee any investment return. Figures shown in the app (portfolio value, earnings) are estimates based on prevailing market prices.

8. Complaints and contact

Complaints can be lodged via your dashboard or by email to support@africabtc.fund. If you are not satisfied with our resolution, you may escalate to the Regulatory Authority once designated under the Act.

9. Changes to these terms

We may update these terms from time to time. Material changes will be notified to you in advance via the platform or email.
